RULES FOR PARTICIPATION IN THE INITIATIVE AND PRIVACY POLICY
INDRA SISTEMAS, S.A. (hereinafter, “Indra”), with tax ID No. A-28599033 and registered address at Avda. de Bruselas 35, Alcobendas 28108, parent company of the trading group Indra, is going to undertake an initiative entitled "Learning makes us better".
The initiative shall be governed by the following rules:
1.- Purpose of the initiative:
Indra is launching the “Learning makes us better” initiative (hereinafter the “Initiative”) so that participants can explain what they have learned and what has helped them to become better, whether it be a professional or a personal experience..
2.- Conditions of participation:
Participation is open to any Indra professional who has a contract of employment or is currently undertaking an academic internship with Indra, or with any of its national or international subsidiaries wholly owned by Indra, (hereinafter, the “Participant”).
3.- Duration of the initiative:
The initiative will commence on September 19, 2016 (12 noon GMT + 1) and end on October 17, 2016 (12 noon GMT + 1), although Indra reserves the right to extend its duration.
4.- Dynamics of the initiative:
Mechanics and development:
A specific website has been developed for the Initiative where Indra professionals can share their own story related to the topic along with a photograph to illustrate it (hereinafter, the “Website”).
The Website will contain a form for professionals to submit their story along with their first name, surname, national/foreign ID number, city, corporate email address, and the aforementioned accompanying photo.
The story must be told in no more than 280 characters and may be written in any of the official languages.
The photograph must adopt the following formats: jpg, png, tiff, 2MB maximum, scale 3:4. The Participant must own the image or its copyright.
The Initiative organizers will review all stories and images submitted and appraise them for publication. Any stories or images that are unrelated to the topic, are abusive, use coarse language or are offensive will be rejected for All Initiative Participants will receive an email at the address they have supplied, either informing them of the publication of their story or explaining why it has been rejected for publication.
Each Participant may only participate once in the Initiative, and consequently only the first story submitted will be accepted. If a story is not published because it does not conform to these rules, the Participant may send a new story rectifying the shortcomings identified.
All stories published will be open to expressions of opinion (through the "Like" feature) by visitors to the Website.
Indra reserves the right to remove the post count and "Like" feature if it believes that the functionality is attracting only minimal use by visitors.
Access mode:
All Indra professionals will receive an email with a link to access the Initiative Website.
The Website address will be public and accessible from any Internet connection.
There will also be links to the Initiative Website from Indraweb.
Prize draw:
All stories published between the launch of the Initiative and the last day will enter a prize draw in accordance with the terms and conditions explained below.
5.- Prizes:
All Participants will enter a prize draw to win one of 10 learning experiences of the Plan B-Masterclass variety https://www.planb.es/regalos/34/master-class# or similar, each worth 70 euros or its equivalent in the local currency (hereinafter, the "Prize")
Notwithstanding the foregoing, due to the territorial reach of the initiative, this being both Indra and its national and international subsidiaries, and the difficulty in making the Prize identical depending on the society where the Participant is based, the nature of the Prize may be subject to change after the draw, although its monetary equivalent and purpose ("keep learning") will be ensured in all cases.
Prizes may not be exchanged for money and no change, amendment or compensation is permitted. Neither may Prizes may be transferred to a third party. Prizes will not be presented to professionals other than the Participants who win the draw in accordance with the mechanics explained in these rules. Prizes are personal and non-transferable. Winning Participants who are no longer employed by Indra on the date the Initiative ends and the draw takes place will not be entitled to claim their Prize.
The draw will take place during the week after the completion of the Initiative and will be held in the presence of Mr. Von Wichmann Gerardo Rovira, Notary of Alcobendas (Madrid).
The date of the draw and the list of winners will be published on the dedicated Website within 10 days of the end of the Initiative.
6.- User obligations:
Participants of the “Learning makes us better” Initiative are obliged to accept the legal rules of the Initiative and the accompanying legal terms and condition.
Participants will be responsible for the image they upload and must guarantee that the contents are original, comply with the applicable legislation, and do not violate the intellectual property rights of any third parties or any other rights whatever their nature. Participants must also have full powers to transfer all the intellectual property rights, -except for the moral rights-.
Participants authorize Indra to reproduce and use their first name and surname. They also transfer the copyright of the image supplied so that it may be used in any activity related to the Initiative, anytime and anywhere, without said use conferring on the participants the right to remuneration or any other benefit.
Indra shall not be held liable for the incorrect use of the Website. All Participants are responsible for the correct use and legality of any actions they undertake in relation to the Initiative.
Indra reserves the right to exclude and veto any Participant who uses the Website or the information supplied for unlawful purposes. In such cases, the Participant will forfeit their right to participate in the prize draw at the end of the Initiative.
7.- Website terms of use:
Participants may access and browse the Initiative Website freely, without the need to register. They will only have to fill out the aforementioned form if they wish to participate in the Initiative.
To participate in the draw and be eligible for prizes, Participants must supply true, accurate, current and authentic personal data, and they must be able to prove that this is the case if requested to do so by Indra. If a user has published more than one story and this breach of the rules has not been detected, they will automatically be excluded from the draw.
Participation in this Initiative implies acceptance of the rules and privacy policy.
The platform will be available in Spanish, English and Portuguese, although the stories published in each language version will only appear in the language in which they were submitted.
Indra shall not be held liable for Participants being unable to access the Website permitting participation in the Initiative due to errors or failures in Internet connections and communications, or due to problems with the Neither shall Indra be held liable for any malfunctions or errors that may arise when participating in the Initiative, or for any interruptions, deletions or incorrect transmissions of the standard email due to a transmission failure.
8.- Privacy and personal data protection:
Participation in the Initiative requires employees to supply the personal data requested on the registration form, and participants therefore consent to the inclusion of these data in a file owned by INDRA and their processing for the sole purpose of promoting this Initiative.
Participants guarantee that the personal data supplied to Indra for the purposes of this Initiative are true and they undertake to inform the company of any change in them.
Participants may exercise their rights of access, correction, cancellation and opposition in the terms specified in the Spanish Personal Data Protection Act (LOPD) by writing to aprendernoshacemejores@indracompany.com (Headquarters: Avenida de Bruselas 33-35, 28108 Alcobendas-Madrid), enclosing a copy of their ID card.
Lastly, if Participants supply names, images or any other type of personal data about third parties, they must guarantee that they have the consent of said parties for the use of their data and that they have informed them of their rights in this matter and of the rules of this Initiative.
9.- Tacit acceptance of the rules. Filed with a notary public:
Participation in this Initiative implies acceptance of all the rules herein. Partial or total noncompliance with them will be grounds for disqualifying the Participant.
Indra reserves the right to revise these participation rules and the privacy policy at any time and for any reason. In such a case, registered users will be informed online via the Website.
10.- Legislation and jurisdiction:
These rules are governed by Spanish law, expressly waiving any other jurisdiction that may apply. Any dispute that may arise in connection with their interpretation or application shall be submitted to the Courts of Madrid.
